NOTICE OF MITIGATION PLAN SUBMITTED BY J.R. SIMPLOT COMPANY IN RESPONSE TO THE SURFACE WATER COALITION WATER DELIVERY CALL
Notice is hereby given that on July 17, 2025, J.R. Simplot Company ("Simplot"), through James B. Alderman, Senior Vice President and Secretary, PO Box 27, Boise, ID 83707, submitted an Application for Approval of Mitigation Plan ("Simplot Plan") to the Idaho Department of Water Resources ("Department").
The Simplot Plan is intended to satisfy part of Simplot's mitigation obligation the Surface Water Coalition ("SWC") Water Delivery Call administered by the Department and watermasters of state water districts who administer ground water rights within the Eastern Snake Plain Aquifer. The SWC consists of irrigation water delivery entities with senior surface water rights diverted from the Snake River above Milner Dam. The SWC members include A&B Irrigation District, American Falls Reservoir District #2, Burley Irrigation District, Milner Irrigation District, Minidoka Irrigation District, North Side Canal Company, and Twin Falls Canal Company.
The Simplot Plan seeks to mitigate for Water Right Nos. 29-7089 and 29-2515, which are used to divert ground water for agricultural irrigation on the Eastern Snake River Plain. Simplot estimates the steady state impacts of pumping ground water under Water Right Nos. 29-7089 and 29-2515 on the Snake River to be 704 acre-feet. Simplot has contracted with the U.S. Department of Interior Bureau of Reclamation for storage of up to 2,500 acre-feet of water in the reservoir behind Palisades Dam. Simplot proposes to use up to 704 acre-feet of water stored in Palisades Reservoir to mitigate injury to the Twin Falls Canal Company for use as needed. Simplot will divert no more than 704 acre-feet from the point of diversion authorized under Water Right Nos. 29-7089 and 29-2515 during the 2025 irrigation season. Simplot's point of diversion is metered, and pumping volumes will be recorded and reported to Water District 120 to ensure compliance.
The Department will process the Simplot Plan under the Department's Conjunctive Management Rules (IDAPA 37.03.11). A complete copy of the Simplot Plan is available for review at the following website link: https://idwr.idaho.gov/legal-actions/mitigation-plan-actions/SWC/simplot/.
This notice does not represent analysis or approval of the proposed plan by the Department. Protests against approval of the Simplot Plan must be filed with the Department, together with a protest fee of $25.00, on or before August 25, 2025. Rule 53 of the Department's Rules of Procedure (IDAPA 37.01.01.053) outlines how documents may be filed with the Department and when they are considered filed. The protest must include a certificate of service showing that a copy of the protest has been mailed or delivered personally to James B. Alderman for Simplot.
