SUMMARY OF ORDINANCE NO. 4949
ORDINANCE NO. 4949: AN ORDINANCE OF THE CITY OF LEWISTON IMPLEMENTING THE CITY COUNCIL'S DECISION IN ZNC25-1, DECLARING THAT CERTAIN REAL PROPERTY BE REMOVED FROM THE COMMUNITY COMMERCIAL (C-3) ZONE AND AGRICULTURAL TRANSITIONAL (F-2) ZONE TO THE GENERAL COMMERCIAL (C-4) ZONE; AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF LEWISTON; AND PROVIDING AN EFFECTIVE DATE.
Section 1 removes the real property described in Exhibit A from the Community Commercial (C-3) and Agricultural Transition (F-2) Zones and includes said real property in the General Commercial (C-4) Zone. Section 2 amends the Zoning Map of the City of Lewiston accordingly. Section 3 provides an effective date.
As required by Idaho Code 50-901A, the following excerpts from Ordinance No. 4949 are required to be published in full:
WHEREAS, the real property described in Section 1 is within the Community Commercial (C-3) Zone and the Agricultural Transition (F-2) Zone, and consists of a 7.24-acre parcel of land generally located at the intersection of Stewart Avenue and Thain Grade;
SECTION 1: The real property described in Exhibit A, attached hereto and incorporated herein, is hereby removed from the Community Commercial (C-3) and Agricultural Transition (F-2) Zone, and included in the General Commercial (C-4) Zone, as defined by the Zoning Ordinance of the City of Lewiston, Idaho.

Legal Description of Rezoned Property
All of the following property in the County of Nez Perce, State of Idaho, to-Wit:
A parcel of land located in part of the Southeast Quarter of the Northwest Quarter and the Southwest Quarter of the Northeast Quarter of Section 8, Township 35 North, Range 5 WBM, described as follows:
Beginning at the monument located at the intersection of the centerlines of Eighth Street and Stewart Avenue; thence West along the centerline of Stewart Avenue 238.11 feet; thence North 10°09'49" West 569.55 feet to a 185.00 foot radius curve to the right, having a delta angle of 67°36'22" and a cord bearing of North 23°38'22" East 205.85 feet; thence Northeasterly along said curve 218.69 feet; thence North 10°09'49" West 91.86 feet; thence; thence East 225.01 feet to the West line of Thain Road, said point on a 884.93 foot radius curve to the right, having a delta angle of 22°28' and a cord bearing of South 22°44'00" East 344.78 feet; thence South-easterly along said curve 347.00 feet to the end of said curve; thence South 11°30' East along the West line of Thain Road 532.30 feet to the centerline of Stewart Avenue; thence West along the centerline of Stewart Avenue 192.10 feet to the Point of Beginning.
The street address of the property described in Exhibit A is 805 Stewart Avenue, Lewiston, Idaho 83501.
Ordinance No. 4949 is effective upon passage and publication and after the publication.
