SUMMARY OF ORDINANCE NO. 4954
ORDINANCE NO. 4954: AN ORDINANCE OF THE CITY OF LEWISTON IMPLEMENTING THE CITY COUNCIL'S DECISION IN ZNC25-2, DECLARING THAT CERTAIN REAL PROPERTY BE REMOVED FROM THE AGRICULTURAL TRANSITIONAL (F-2) ZONE TO THE GENERAL COMMERCIAL (C-4) ZONE; AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF LEWISTON; AND PROVIDING AN EFFECTIVE DATE.
Section 1 removes the real property described in Exhibit A from the Agricultural Transition (F-2) Zones and includes said real property in the General Commercial (C-4) Zone. Section 2 amends the Zoning Map of the City of Lewiston accordingly. Section 3 provides an effective date.
As required by Idaho Code 50-901A, the following excerpts from Ordinance No. 4954 are required to be published in full:
WHEREAS, the real property described in Section 1 is within the Agricultural Transition (F-2) Zone, and consists of an approximately 4.83-acre parcel of land generally located immediately west of 805 Stewart Avenue, on the north side of Stewart Avenue, and directly across Stewart Avenue from 728 Stewart Avenue;
SECTION 1: The real property described in Exhibit A, attached hereto and incorporated herein, is hereby removed from the Agricultural Transition (F-2) Zone, and included in the General Commercial (C-4) Zone, as defined by the Zoning Ordinance of the City of Lewiston, Idaho.

Legal Description of Rezoned Property
All of the following property in the County of Nez Perce, State of Idaho, to-Wit:
A parcel of land located in part of the Southeast Quarter of the Northwest Quarter and the Southwest Quarter of the Northeast Quarter of Section 8, Township 35 North, Range 5, West of the Boise Meridian, described as follows:
Commencing at the monument located at the intersection of the centerline of Stewart Ave and Eighth Street; thence West along the centerline of Steward Avenue and 238.11 feet to the Point of Beginning;
thence continue West along said centerline 253.89 feet; thence N.8°12'00 W., 848.28 feet; thence East 340.72 feet; thence S.10°09'49"E. 91.86 feet to the beginning of a 185.00 foot radius curve to the left having a delta angle of 67°36'22" and a cord bearing of S.23°38'22"W. 205.85 feet; thence Southwesterly along said curve 218.29 feet to the end of said curve; thence S.10°09'49" E. 569.55 feet to the point of beginning.
There is no street address for the property described in Exhibit A, however, it is located immediately to the west and is abutting 805 Stewart Avenue, Lewiston, Idaho 83501.
Ordinance No. 4954 is effective upon passage and publication and after the publication.
