206312 W. TIMOTHY SEIBLY (Resignation in Lieu of Disciplinary Proceedings) On October 20, 2026, the Idaho Supreme Court entered an Order accepting the resignation in lieu of disciplinary proceedings of Lewiston attorney W. Timothy Seibly. The Idaho Supreme Court's Order followed a stipulated resolution of a disciplinary proceeding that related to the following conduct. Mr. Seibly's malpractice coverage through ALPS expired on January 1, 2020. Despite being on notice that his ALPS malpractice coverage had lapsed, Mr. Seibly falsely certified to the Idaho State Bar (ISB) in February 2020, January 2021, February 2022, January 2023, January 2024, and March 2025, that his ALPS coverage was effective. Mr. Seibly obtained malpractice insurance in May 2025. In September 2025, Mr. Seibly informed the ISB of his prior lapse in malpractice coverage. Mr. Seibly admitted this conduct violated Idaho Rule of Professional Conduct (IRPC) 8.4(c) [it is professional misconduct for a lawyer to engage in conduct involving dishonesty, fraud, deceit or misrepresentation], IRPC 5.5(a) [a lawyer shall not practice law in a jurisdiction where doing so violates the regulation of the legal profession in that jurisdiction], and Idaho Bar Commission Rule (IBCR) 302(a)(5) [a lawyer representing private clients shall submit proof of current professional liability insurance coverage and shall notify the Bar in writing within thirty (30) days if the coverages lapses, is no longer in effect, or terminates for any reason]. The Idaho Supreme Court accepted Mr. Seibly's resignation in lieu of disciplinary proceedings. By the terms of the Order, Mr. Seibly may not make application for admission to the Idaho State Bar sooner than five (5) years from the date of his resignation. If he does make such application for admission, he will be required to comply with all the bar admission requirements in Section II of the Idaho Bar Commission Rules and shall have the burden of overcoming the rebuttable presumption of the "unfitness to practice law." By the terms of the Idaho Supreme Court's Order, Mr. Seibly's name was struck from the records of the Idaho Supreme Court and his right to practice law before the courts in the State of Idaho was terminated on October 20, 2026.
