CITY OF LEWISTON SUMMARY OF ORDINANCE NO. 4969 ORDINANCE NO. 4969: AN ORDINANCE OF THE CITY OF LEWISTON IMPLEMENTING THE CITY COUNCIL'S DECISION IN ZNC24-5, UPZONING APPROXIMATELY 704 PARCELS OF REAL PROPERTY GENERALLY LOCATED ON THE EAST SIDE OF 21ST STREET, BETWEEN EAST MAIN STREET AND NEZ PERCE DRIVE, AND THE WEST SIDE OF 21ST STREET, BETWEEN 19TH AVENUE AND 11TH AVENUE FROM THE LOW DENSITY RESIDENTIAL, R-2, ZONE AND MEDIUM DENSITY RESIDENTIAL, R-3, ZONE TO THE MEDIUM DENSITY RESIDENTIAL, R-3, ZONE, THE HIGHER DENSITY RESIDENTIAL, R-4, ZONE, THE GENERAL COMMERCIAL, C-4, ZONE AND THE REGIONAL COMMERCIAL, C-6, ZONE AS SET FORTH HEREIN; PROVIDING THAT ALL PRIOR ZONES APPLICABLE TO THE LANDS DESCRIBED HEREIN ARE HEREBY SUPERSEDED; AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF LEWISTON ACCORDINGLY; AND PROVIDING AN EFFECTIVE DATE. Section 1 removes the real property described in Exhibit A from Low Density Residential (R-2) Zone and includes said real property in the Medium Density Residential (R-3) Zone. Section 2 removes the real property described in Exhibit B from R-2 Zone and includes said real property in the R-3 Zone. Section 3 removes the real property described in Exhibit C from R-2 Zone and includes said real property in the R-3 Zone. Section 4 removes the real property described in Exhibit D from R-2 Zone and includes said real property in the Higher Density Residential (R-4) Zone. Section 5 removes the real property described in Exhibit E from R-2 Zone and includes said real property in the R-4 Zone. Section 6 removes the real property described in Exhibit F from R-2 Zone and includes said real property in the Regional Commercial (C-6) Zone. Section 7 removes the real property described in Exhibit G from R-2 Zone and includes said real property in the General Commercial (C-4) Zone. Section 8 removes the real property described in Exhibit H from R-2 Zone and includes said real property in the C-6 Zone. Section 9 removes the real property described in Exhibit I from R-3 Zone and includes said real property in the C-6 Zone. Section 10 supersedes all prior zoning designations for the affected lands. Section 11 amends the Zoning Map of the City of Lewiston accordingly. Section 12 provides an effective date. As required by Idaho Code 50-901A, the following excerpts from Ordinance No. 4963 are required to be published in full: WHEREAS, the City of Lewiston has conducted the hearings required by law to evaluate ZNC24-5, a City-initiated request to rezone the property listed in Sections 1 through 9 below, and have adopted a Reasoned Statement, all in accordance with Idaho Code 67-6509, 67-6511, and 67-6535. SECTION 1: The real property depicted in Exhibit A (Map 1A), attached hereto and incorporated herein, generally located south of East Main Street, west of Silcott Street and 29th Street, north of 16th Avenue, and east of 21st Street, in Lewiston, Idaho is hereby removed from the Low Density Residential, R-2, Zone, and included in the Medium Density Residential, R-3, Zone, as defined by the Zoning Ordinance of the City of Lewiston, Idaho. SECTION 2: The real property depicted in Exhibit B (Map 2A), attached hereto and incorporated herein, generally located south of 11th Avenue, west of 19th Street, north of 18th Avenue, and east of 17th Street, in Lewiston, Idaho is hereby removed from the Low Density Residential, R-2, Zone, and included in the Medium Density Residential, R-3, Zone, as defined by the Zoning Ordinance of the City of Lewiston, Idaho. SECTION 3: The real property depicted in Exhibit C (Map 1B - Amendment), attached hereto and incorporated herein, generally located south of 11th Avenue to vacated 15th Avenue, and east of 23rd Street to 24th Street, in Lewiston, Idaho is hereby removed from the Low Density Residential, R-2, Zone, and included in the Medium Density Residential, R-3, Zone, as defined by the Zoning Ordinance of the City of Lewiston, Idaho. SECTION 4: The real property depicted in Exhibit D (Map 1B - Amendment), attached hereto and incorporated herein, generally located south of 11th Avenue to 14th Avenue, and west of 23rd Street to 21st Street, in Lewiston, Idaho is hereby removed from the Low Density Residential, R-2, Zone, and included in the Higher Density Residential, R-4, Zone, as defined by the Zoning Ordinance of the City of Lewiston, Idaho. SECTION 5: The real property depicted in Exhibit E (Map 2B), attached hereto and incorporated herein, generally located south of 11th Avenue, west of 20th Steet, north of 17th Avenue, and east of 19th Street, in Lewiston, Idaho is hereby removed from the Low Density Residential, R-2, Zone, and included in the Higher Density Residential, R-4, Zone, as defined by the Zoning Ordinance of the City of Lewiston, Idaho. SECTION 6: The real property depicted in Exhibit F (Map 1D), attached hereto and incorporated herein, generally located south of 14th Avenue, west of the real property at 2604 16th Avenue, north of the vacated 17th Avenue, and east of 21st Street, in Lewiston, Idaho is hereby removed from the Low Density Residential, R-2, Zone, and included in the Regional Commercial, C-6, Zone, as defined by the Zoning Ordinance of the City of Lewiston, Idaho. SECTION 7: The real property depicted in Exhibit G (Map C), attached hereto and incorporated herein, identified as 2604 16th Avenue, in Lewiston, Idaho is hereby removed from the Low Density Residential, R-2, Zone, and included in the General Commercial, C-4, Zone, as defined by the Zoning Ordinance of the City of Lewiston, Idaho. SECTION 8: The real property depicted in Exhibit H (Map 2D), attached hereto and incorporated herein, identified as 2020 12th Avenue, 1220 21st Street, and 2010 16th Avenue, in Lewiston, Idaho are hereby removed from the Low Density Residential, R-2, Zone, and included in the Regional Commercial, C-6, Zone, as defined by the Zoning Ordinance of the City of Lewiston, Idaho. SECTION 9: The real property depicted in Exhibit I (Map 2D), attached hereto and incorporated herein, identified as 1702 18th Avenue, 1720 18th Avenue, 1816 18th Avenue, 1821 17th Street, and 1827 17th Street, in Lewiston, Idaho are hereby removed from the Medium Density Residential, R-3, Zone, and included in the Regional Commercial, C-6, Zone, as defined by the Zoning Ordinance of the City of Lewiston, Idaho.
