205116 ORDINANCE NO. 123 AN ORDINANCE OF NEZ PERCE COUNTY AMENDING AND ENACTING IN TITLE 112, (SECTION 101.01.030 and 112.12.050), OF THE NEZ PERCE COUNTY LAND DEVELOPMENT CODE (LDC), AND FURTHER PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF NEZ PERCE COUNTY, IDAHO: Section 1. Nez Perce County Code Title 112, Section 101.01.030, is hereby amended as follows: Sec. 101.01.030 Definitions. The following language will be amended in Section 101.01.030: Household pets: small animals permitted in the house or yard and kept for company or pleasure, such as dogs, cats, pot-bellied pigs registered with the American Mini Pig Association, rabbits, guinea pigs, hamsters, or other small fur-bearing animals; canaries, parrots, goldfish, etc. In the Lewiston Area of Impact, pot-bellied pigs shall be kept in accordance with Section 112.12.050. Section 2. Nez Perce County Code Title 112, Section 112.12.050, is hereby amended as follows: Sec. 112.12.050 Animal Rights, livestock, and pasture standards. The following language will be amended in Section 112.12.050(c)(2): (2) Swine, geese or male chickens. The keeping of swine, except pot-bellied pigs defined as a household pet in Section 101.01.030, geese or male chickens (i.e., roosters) is prohibited. a. Pot-bellied pigs. Two per lot in the R-1 zone. In the F-1 or F-2 zone two per lot shall be permitted, more than two pot-bellied pigs shall require a conditional use permit. Section 3. This ordinance shall take effect and be in force from and after passage, approval and publication as required by law.
