204963 The City of Lewiston is publishing the following ordinance pursuant to Idaho Code 50-329. The ordinance was read and considered at the City Council meetings on February 23 and March 9, with the final reading and adoption on May 11, 2026. CITY ORDINANCE NO. 4956 AN ORDINANCE OF THE CITY OF LEWISTON AMENDING THE FRANCHISE AGREEMENT FOR COLLECTION, HAULING, AND TIPPING OF RESIDENTIAL AND COMMERCIAL SOLID WASTE, YARD WASTE, AND RECYCLABLE MATERIALS BETWEEN THE CITY OF LEWISTON AND SANITARY DISPOSAL, INC., DOING BUSINESS AS SUNSHINE DISPOSAL & RECYCLING, AN IDAHO CORPORATION GRANTED PURSUANT TO LEWISTON CITY ORDINANCE NO. 4823 ON NOVEMBER 1, 2021; AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AND ATTEST SAID AMENDMENT TO THE FRANCHISE AGREEMENT, RESPECTIVELY; PROVIDING THAT THE PROVISIONS OF THIS ORDINANCE ARE DEEMED SEVERABLE; AND PROVIDING AN EFFECTIVE DATE WHEREAS, the City of Lewiston ("City") and Sanitary Disposal, Inc., doing business as Sunshine Disposal & Recycling ("Franchisee"), are parties to that certain "Franchise Agreement for Collection, Hauling, and Tipping of Residential and Commercial Solid Waste, Yard Waste, and Recyclable Materials" ("Agreement"), which was approved and adopted through Ordinance No. 4823, with the ordinance passed November 22, 2021, and the Franchise Agreement effective December 1, 2021; and WHEREAS, the Franchise Agreement provides that it may be amended only by a writing duly executed by both parties, and establishes procedures for initiating and negotiating amendments; and WHEREAS, the parties have adhered to the procedures for initiation and negotiation of amendments set forth in the Agreement; and WHEREAS, the Lewiston City Council finds it in the best interests of the City to amend the Franchise Agreement and to authorize execution of the amendment in accordance with the procedures outlined above; and NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF LEWISTON, IDAHO: SECTION 1: The "Amendment to the Franchise Agreement for Collection, Hauling, and Tipping of Residential and Commercial Solid Waste, Yard Waste, and Recyclable Materials" ("Amendment") is hereby approved. A copy of said Amendment is attached hereto and incorporated herein as Exhibit A. SECTION 2: The Mayor and City Clerk are hereby authorized and directed to execute and attest the Amendment, respectively. SECTION 3: The provisions of this Ordinance shall be deemed severable and the invalidity of any provision of this Ordinance shall not affect the validity of the remaining provisions. The remaining sections of Ordinance No. 4823 not modified through this Amendment shall remain in full force and effect.
