ORDINANCE NO. 120
AN ORDINANCE OF NEZ PERCE COUNTY AMENDING AND ENACTING IN TITLE 112, (ARTICLE II, SECTION 112.08.170, 112.08.180), OF THE NEZ PERCE COUNTY LAND DEVELOPMENT CODE (LDC), AND FURTHER PROVIDING FOR AN EFFECTIVE DATE.
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF NEZ PERCE COUNTY, IDAHO:
Section 1. Nez Perce County Code Title 112, Article II, Section 112.08.170, is hereby amended as follows:
Sec. 112.08.170. Conditional uses permitted.
The following language will be added in Section 112.08.170:
(12) Auto service, subject to special conditions of section 112.08.180(d).

Sec. 112.08.180 Special Conditions.
The following language will be added in Section 112.08.180:
(d) Auto service standards.
(1) The footprint of the auto service building shall be no larger than five thousand (5,000) square feet.
(2) The operating hours shall be limited to the hours of 7:00 am to 6:00 pm, Monday through Friday.
(3) All repair and service work shall be done within an enclosed building or a screened area.
(4) All vehicles that are repaired and are waiting to be picked up shall be parked on-site. A maximum of ten (10) vehicles shall be allowed to be stored in parking areas after operating hours. Notwithstanding the limitation on operating hours, vehicle pick-up and drop-off is permitted between the hours of 7:00 am and 8:00 pm, Monday through Saturday.
(5) Temporary storage of vehicles dropped off for repairs or service is permitted. Junk vehicles shall not be stored on site except within an enclosed building. Inoperable vehicles shall not be stored on site for purposes other than repair or service.
(6) Any garbage, waste, or other refuse not stored within an enclosed building shall be placed into a refuse receptacle, not exceeding its capacity.
(7) All exterior lighting shall be shielded, located, and designed to prevent glare or light spillover onto adjacent residential properties, consistent with section 112.12.090.
(8) Any fluids (oils, lubricants, solvents, etc.) used by an auto service shall be stored in an enclosed building. Storage handling and disposal of all waste products shall be done in accordance with applicable law. Tires, whether new or used, shall be stored in an enclosed building. The disposal of tires shall be done in accordance with applicable law.
(9) Only one on-premises, exterior sign advertising the auto service is allowed. The exterior sign shall be unlighted/non-illuminated and no larger than 32 square feet. No other display, including a window display, advertising the auto service is allowed. Signs shall otherwise satisfy the requirements of section 112.12.150.
(10) Off-street parking shall be provided to serve the auto service as follows: one space per 600 square feet of floor area plus one per two employees.
(11) Access to the site meets all applicable ordinances.
Section 3. This ordinance shall take effect and be in force from and after passage, approval and publication as required by law.
Regularly passed, approved, and adopted by the Board of Commissioners of the County of Nez Perce, state of Idaho, on this 13th day of April, 2026, nunc pro tunc to February 2, 2026.
