ORDINANCE NO. 2026-02
AN ORDINANCE OF THE CITY OF TROY, LATAH COUNTY, STATE OF IDAHO, AMENDING TITLE 9 OF THE TROY CITY CODE; PROVIDING UPDATED LAND USE REGULATIONS; ADOPTING LEGISLATIVE FINDINGS; AND PROVIDING FOR AN EFFECTIVE DATE.
SECTION 1. RECITALS
WHEREAS, the City of Troy is vested with the statutory authority under Idaho Code 67-6524 to adopt interim ordinances and zoning amendments when a plan, plan component, or amendment is being prepared; and
WHEREAS, the City has been engaged in a comprehensive review and update of its zoning ordinance and comprehensive plan for more than two (2) years, during which time the City has identified inconsistencies, outdated provisions, and land-use classifications requiring modernization; and
WHEREAS, on April 9, 2025, the City Council adopted Interim Ordinance 2025-02, which amended Title 15, Chapter 155, Section 155.260 of the Troy City Code temporarily to clarify allowed uses within the Central Business District (C-1) and to ensure that development occurring during the update process would be consistent with the City's long-term planning goals; and
WHEREAS, Interim Ordinance 2025-02 stated that "certain provisions contained in the Troy City Code need to be amended on an interim basis to best serve the needs of the City of Troy and its residents, as well as to provide a consistent and proper framework for future growth," and temporarily reclassified several uses within the C-1 District from permitted or conditional uses to "Not Allowed" uses; and
WHEREAS, the City Council now finds it necessary and appropriate to transition from the interim ordinance to a permanent amendment that reflects the City's updated planning objectives, protects the integrity of the Central Business District, and ensures that land-use regulations remain consistent, predictable, and aligned with the City's vision for future development; and
WHEREAS, the City Council further finds that the amendments contained in this ordinance are in the public interest, promote the health, safety, and general welfare of the community, and are consistent with the goals and policies of the City's comprehensive planning efforts.
SECTION 2. LEGISLATIVE FINDINGS
The City Council hereby adopts the following findings:
1. Need for Clarity and Consistency.
The interim amendments adopted in 2025-02 demonstrated the need for clearer, more consistent land-use classifications within the Central Business District (C-1), particularly regarding uses that may conflict with the district's commercial character or impede future economic development.
2. Protection of the Central Business District.
The C-1 District serves as the commercial and civic core of the city. Ensuring that land uses within this district support economic vitality, pedestrian activity, and compatible development patterns is essential to the long-term success of the community.
3. Alignment with Comprehensive Planning.
The City's ongoing zoning and comprehensive plan update process has identified the need to modernize the land-use schedule, remove outdated or incompatible uses, and ensure that zoning regulations reflect current community goals and anticipated growth patterns.
4. Transition from Interim to Permanent Regulation.
Interim Ordinance 2025-02 was adopted to prevent incompatible development during the planning process. The City Council now finds that permanent amendments are necessary to replace the interim provisions and provide long-term regulatory stability.
5. Public Welfare.
The amendments contemplated herein promote the public health, safety, and welfare by ensuring that land-use regulations are clear, enforceable, and aligned with the City's planning objectives.
SECTION 3. AMENDMENTS TO TITLE 15
Troy City Code Title 15, Land-Usage; Chapter 155, Zoning; The City of Troy Zoning Districts Map is hereby amended, and adopted, as shown in Exhibit A. Troy City Code Title 15, Land-Usage; Chapter 155, Zoning; Subsection 155.150, Central Business District (C-1) is hereby amended, and adopted, as shown in Exhibit B. Troy City Code Title 15, Land-Usage; Chapter 155, Zoning; Subsection 155.261, Schedule of District Land Use Controls is hereby amended, and adopted, as shown in Exhibit C.
SECTION 4. SEVERABILITY
If any section, subsection, sentence, clause, or phrase of this ordinance is declared unconstitutional or invalid, such decision shall not affect the remaining portions of this ordinance.
SECTION 5. EFFECTIVE DATE
This ordinance shall be in full force and effect upon its passage, approval, and publication according to law.
