NOTICE OF TRUSTEE'S SALE
NOTICE IS HEREBY GIVEN that on the 15th day of December 2021, at the hour of Ten o'clock A.M., of said day at the office of TitleOne whose address is 1230 Idaho Street, Lewiston, ID 83501, the successor Trustee, Jennifer Tengono of Susan R. Wilson, Attorney at Law, will sell at public auction, to the highest bidder, for cash (the Trustee is authorized to make a credit bid for the Beneficiaries) in lawful money of the United States of America, all payable at the time of the sale, that certain real property located in the County of Nez Perce, State of Idaho, and legally described as follows:
&tempmargin;Lots 1, 2, and 3 in Block 3 of East Terrace Addition to the City of Lewiston, according to the official plat thereof, filed in Book 2B of Plats at Page(s) 74, Official Records of Nez Perce County, Idaho.
&tempmargin;EXCEPT a portion of Lot 1 in Block 3 of the East Terrace Addition to the City of Lewiston, County of Nez Perce, State of Idaho and being more particularly described as follows:
&tempmargin;Beginning at the Northeast corner of Lot 1 of Block 3 of the East Terrace Addition to the City of Lewiston, which is (9.144 meters) 30.00 feet right of Sta. 5+932.573 of Federal Aid Project No. STP-7124 (100); thence South 38?18’53” East along the East line of Lot 1 for (2.452 meters) 8.04 feet to the point on a curve; thence along the curve to the left having a radius of (11.105 meters) 36.43 feet, a central angle of 37?48’45” and a long chord of (7.197 meters) 23.61 feet, that bears South 89?29’46” West for an arc length of (7.329 meters) 24.05 feet; thence North 70?42’16” East along the South line of Main Street for (6.014 meters) 19.73 feet to the Point of Beginning.
For the purposes of compliance with Idaho Code 60-113, and according to the information available to the Trustee, the Trustee has been informed that the address of 2904 Main Street, Lewiston, ID 83501, may sometimes be associated with said real property.
Said sale will be made without covenant or warranty regarding title, possession or encumbrances to satisfy the obligation secured by and pursuant to the power of sale conferred in the Deed of Trust executed by KELLY J. GIESE, as Grantor, to JENNIFER TENGONO of SUSAN R. WILSON, ATTORNEY AT LAW, PLLC, named as Successor Trustee for the benefit and security of DWAIN A. CARLSON, an individual, and BETTY LOU GREELEY, a married person as her sole and separate property, as the Assigned Beneficiaries; said Assignment of Deed of Trust having been recorded on November 24, 2009, as Instrument No. 775637, in the official records of Nez Perce County, Idaho for that certain Deed of Trust executed and filed on February 5, 2002, as Instrument No. 671721, official records of Nez Perce County, Idaho naming Mark E. Evans and Lorri A. Evans, husband and wife, as original Beneficiaries. The above Grantor is named to comply with Idaho Code Section 45-1506(4)(a). No representation is made that he is or is not presently responsible for this obligation.
The default for which this sale is to be made is failure of the Grantor to pay when due the remaining unpaid balance on the date of maturity as set forth on the Note secured by said Deed of Trust. The remaining unpaid balance as of February 1, 2017 was $12,140.12, plus interest, which continues to accrue; along with $1,273.44 in late fees as of July 27, 2021, which continues to accrue; and unpaid property taxes for the 2018, 2019 and 2020 tax years which total $5,754.64 and which continues to accrue penalties and interest. The total amount due under the Note as of July 27, 2021 is $27,078.52, plus late fees and interest which continues to accrue along with any other costs, fees, or expenses incurred by the Beneficiaries and/or Trustee associated with this foreclosure as provided by the Assignment of Deed of Trust, Deed of Trust or Promissory Note, or by Idaho law.
All delinquent amounts are now due, together with any accruing late charges and interest, unpaid and accruing taxes, assessments, trustee's fees, attorney's fees, and any amounts advanced to protect the security associated with this foreclosure.
